1. Acceptance of Terms

By accessing or using NutritionCam, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service. These terms apply to all users, including visitors, registered users, and subscribers.

2. Service Description

NutritionCam is a nutrition awareness platform that uses AI technology to analyze food photos, provide nutritional insights, and suggest healthier alternatives. The service includes a web application, mobile apps, and related features. Nutritional information provided is for informational purposes only and should not be considered medical or dietary advice.

3. User Accounts

You are responsible for maintaining the security of your account credentials and for all activities under your account. You must provide accurate information when creating an account. You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions, Payments & Right of Withdrawal

Some features require a paid subscription. Subscriptions are billed on a recurring basis and will automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends. You may cancel at any time through the customer portal. Prices may change with reasonable notice. Free trial credits are non-transferable.

Right of Withdrawal and Immediate Access. Where applicable law grants you a right of withdrawal or cancellation, you may exercise that right in accordance with applicable law. If you expressly request that NutritionCam begin providing paid services during an applicable statutory withdrawal period, we may begin providing those services immediately. Where permitted by law, you may be required to pay for the portion of the service provided before you exercise your right of withdrawal. Where applicable law permits the loss of a statutory withdrawal right for digital content or other immediately supplied digital services, we will request the required express consent and acknowledgement before such loss takes effect. Nothing in these Terms is intended to waive, restrict, or exclude any statutory consumer right that cannot legally be waived or restricted. Information about how to exercise any applicable withdrawal or cancellation right will be made available through the applicable website or application and in accordance with applicable consumer protection laws.

Billing Disputes. If you believe that a charge was made in error, we encourage you to contact our support team so that we can attempt to resolve the issue promptly. Nothing in this section limits any rights you may have under applicable law or through your payment provider. NutritionCam may suspend or terminate an account where we reasonably believe that a payment dispute, chargeback or other payment activity is fraudulent or abusive, subject to applicable law.

5. User Content & User Responsibility

You retain ownership of the content you upload, including food photos. By using the service, you grant us a limited license to process your content for the purpose of providing the service (e.g., AI analysis). You are responsible for ensuring you have the right to upload any content. We may remove content that violates these terms.

You are responsible for ensuring that information you provide to NutritionCam is accurate and complete. NutritionCam may rely on information, photographs and other content supplied by you when generating analyses and estimates. Incorrect, incomplete or misleading information may result in inaccurate outputs. You are responsible for reviewing AI-generated information and determining whether it is appropriate for your individual circumstances. You must not rely on NutritionCam as the sole basis for decisions involving medical treatment, emergency situations, severe allergies or other circumstances where inaccurate information could result in serious harm.

We do not use your identifiable food photographs or personal content to train general-purpose AI models without your explicit permission.

6. Intellectual Property

NutritionCam, including its design, features, AI models, and content, is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the service without our written permission. The NutritionCam name and logo are trademarks.

7. Disclaimer and Important Safety Information

NutritionCam provides AI-generated nutritional estimates, food analysis and general nutrition awareness information for informational and educational purposes.

NutritionCam is not a healthcare provider and does not provide medical diagnosis, treatment, clinical monitoring or emergency services.

Information generated by NutritionCam, including ingredient identification, portion estimates, calories, macronutrients, micronutrients, nutritional insights and suggestions, may be incomplete, inaccurate or incorrect. Results should not be treated as exact measurements or guaranteed nutritional information.

NutritionCam cannot reliably identify all ingredients, hidden ingredients, allergens, traces of allergens, cross-contamination, exact recipes, exact portion sizes, exact chemical composition or the medical suitability of food for an individual.

You are responsible for independently verifying information that is important to you, particularly information relating to food allergies, intolerances, medical conditions, medication-related dietary restrictions or other health concerns.

NutritionCam must not be used to diagnose, treat, cure, prevent or manage any disease or medical condition and must not be relied upon as a substitute for professional medical, nutritional or healthcare advice.

If you have a medical condition, severe food allergy, special dietary requirement or other health concern, consult an appropriately qualified healthcare professional before making significant dietary decisions.

If you believe you are experiencing a medical emergency or severe allergic reaction, seek emergency medical assistance immediately and do not rely on NutritionCam.

Nothing in these Terms excludes or limits liability or statutory consumer rights where such exclusion or limitation is prohibited by applicable law.

8. AI Systems and Output Limitations

NutritionCam uses automated and artificial intelligence technologies. AI-generated outputs are probabilistic and may contain errors, omissions, inaccuracies or inconsistencies.

AI-generated results may differ between analyses of the same or similar food items and may change as the Service, models, algorithms or data sources are updated.

You should independently verify information that is important to you before relying on it for health, dietary, financial, commercial or other significant decisions.

NutritionCam does not guarantee that any AI-generated output is complete, accurate, current, reliable or suitable for a particular purpose.

You are responsible for reviewing AI-generated results and for your decisions and actions based on those results.

9. Service Availability

NutritionCam is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, timely, or error-free access to the service. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We shall not be liable for any loss or inconvenience caused by service interruptions, including but not limited to missed diet tracking days or lost productivity.

10. Restricted and Commercial Uses

The standard consumer subscription is intended for personal, non-commercial use only. Using NutritionCam for commercial purposes (including but not limited to labeling restaurant menus, generating nutritional data for sale, or integrating the service into third-party products) requires a separate commercial license.

Unless NutritionCam expressly agrees otherwise in writing, the Service must not be used as the sole or primary basis for: medical diagnosis or treatment; clinical decision-making; emergency decision-making; allergen verification; food safety verification; legally required food or nutrition labeling; regulatory compliance determinations; or any safety-critical decision where inaccurate information could reasonably result in serious harm.

If you are a business or use the service on behalf of an organization, you are responsible for how your employees, agents, or customers use the data obtained through the platform. Commercial or professional use of NutritionCam may require a separate written agreement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, NutritionCam and its operators, affiliates, officers, employees, contractors and agents shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business opportunity, goodwill or data, arising from or relating to the use of the Service.

NutritionCam is not responsible for decisions made by users based on AI-generated estimates, nutritional information, suggestions, recommendations or other outputs provided through the Service, except to the extent liability cannot legally be excluded or limited.

To the maximum extent permitted by applicable law, NutritionCam's aggregate liability arising out of or relating to the Service shall not exceed the greater of: (a) the amount paid by the user to NutritionCam for the Service during the twelve (12) months preceding the event giving rise to the claim; or (b) EUR 100.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, intentional misconduct, gross negligence where such liability cannot legally be excluded, death or personal injury where applicable law prohibits exclusion or limitation, or any other liability that cannot legally be excluded or limited.

Nothing in these Terms affects mandatory consumer rights or statutory remedies that cannot be waived or restricted under applicable law.

12. Termination

You may terminate your account at any time by contacting support or through account settings. We may terminate or suspend your access for violation of these terms, with notice where possible. Upon termination, your right to use the service ceases. You may request export of your data before termination.

13. Changes to Terms

We may update these terms from time to time. Significant changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the service after changes constitutes acceptance of the updated terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Netherlands.

However, if you are a consumer, you may also benefit from mandatory provisions of the law of the country in which you have your habitual residence where those provisions cannot legally be excluded by agreement.

Nothing in these Terms deprives a consumer of protections or rights that cannot legally be waived under applicable law.

Subject to mandatory consumer protection laws and mandatory rules regarding jurisdiction, disputes shall be submitted to the competent courts of the Netherlands.
