Rules and conditions for using NutritionCam

1. Acceptance of Terms
By accessing or using NutritionCam, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service. These terms apply to all users, including visitors, registered users, and subscribers.
2. Service Description
NutritionCam is a nutrition awareness platform that uses AI technology to analyze food photos, provide nutritional insights, and suggest healthier alternatives. The service includes a web application, mobile apps, and related features. Nutritional information provided is for informational purposes only and should not be considered medical or dietary advice.
3. User Accounts
You are responsible for maintaining the security of your account credentials and for all activities under your account. You must provide accurate information when creating an account. You may not share your account with others or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these terms.
4. Subscriptions & Payments
Some features require a paid subscription. Subscriptions are billed on a recurring basis and will automatically renew at the end of each billing period unless you cancel at least 24 hours before the current period ends. You may cancel at any time through the customer portal. By subscribing and accessing premium features or initiating your first AI analysis, you expressly agree that the service begins immediately and you waive your 14-day right of withdrawal (cooling-off period) as permitted under EU consumer protection law. Refunds are handled in accordance with applicable consumer protection laws. Prices may change with reasonable notice. Free trial credits are non-transferable. If you have a billing issue or dispute, you must first contact our support team before initiating a chargeback with your payment provider. Filing a fraudulent chargeback may result in permanent account suspension.
5. User Content
You retain ownership of the content you upload, including food photos. By using the service, you grant us a limited license to process your content for the purpose of providing the service (e.g., AI analysis). You are responsible for ensuring you have the right to upload any content. We may remove content that violates these terms.
6. Intellectual Property
NutritionCam, including its design, features, AI models, and content, is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the service without our written permission. The NutritionCam name and logo are trademarks.
7. Disclaimer
NutritionCam provides nutritional information for general awareness purposes only. We do not guarantee the accuracy of AI-generated nutritional data. The service is not a substitute for professional medical or dietary advice. The platform does not monitor your health status and is not a medical device. Always consult a healthcare professional for specific dietary needs or health concerns. We are not liable for decisions made based on the information provided.
8. Health & Allergen Disclaimer
NutritionCam uses AI technology to estimate nutritional content from food photos. The AI cannot detect allergens, exact chemical compositions, hidden ingredients (such as nuts in a sauce, sugar in a dressing, or traces of gluten), or cross-contamination. You are solely responsible for verifying the ingredients of any food you consume, especially if you have food allergies, intolerances, or medical conditions such as diabetes. NutritionCam is not intended to diagnose, treat, or prevent any health condition. If you use the platform to set health goals or dietary preferences, this does not constitute medical monitoring or advice.
9. Service Availability
NutritionCam is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted, timely, or error-free access to the service. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We shall not be liable for any loss or inconvenience caused by service interruptions, including but not limited to missed diet tracking days or lost productivity.
10. Commercial Use
The standard consumer subscription is intended for personal, non-commercial use only. Using NutritionCam for commercial purposes — including but not limited to labeling restaurant menus, generating nutritional data for sale, or integrating the service into third-party products — requires a separate commercial license. If you are a business or use the service on behalf of an organization, you are responsible for how your employees, agents, or customers use the data obtained through the platform. 11. Limitation of Liability
To the maximum extent permitted by law, NutritionCam shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
12. Termination
You may terminate your account at any time by contacting support or through account settings. We may terminate or suspend your access for violation of these terms, with notice where possible. Upon termination, your right to use the service ceases. You may request export of your data before termination.
13. Changes to Terms
We may update these terms from time to time. Significant changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use of the service after changes constitutes acceptance of the updated terms.
14. Governing Law
These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of the Netherlands. If any provision of these terms is found to be unenforceable, the remaining provisions shall remain in effect.
